Banks have a legal duty to keep client’s funds safe and an obligation to undertake due diligence on any transactions proposed by a client to an acceptable standard. It is an obligation banks consistently fail to perform. This leaves banks open to claims for compensation based on negligence, a position the Financial Ombudsman Service across jurisdictions have consistently supported.

We can hold banks accountable even if your money passed through several different payment providers or cryptocurrency exchanges, before reaching the scam – even if your bank has already declined your claim.

If necessary, our lawyers will submit a claim with the Financial Ombudsman Service (FOS) on your behalf.

In 95% of fraud and scam cases we investigate, funds are recovered directly from culpable financial entities, such as banks or intermediary payment providers, without the need to locate the criminals.

What if my bank has already said no?

Your bank may have rejected your claim due to a lack of evidence, or because you were unable to legally demonstrate how your bank is potentially negligent in their legal duty of care to you as a customer. IYE investigations prove criminality to a police prosecution standard. We will represent your case on your behalf with new evidence by applying our exceptional understanding of criminal and financial law.

Importantly, our legal challenge to your bank or other culpable entity will be written and submitted by our legal team, IYE Legal, which is regulated by the Solicitors Regulatory Authority (SRA).

What if my money passed through multiple payment systems?

If your money originated in a bank account, it is irrelevant how many intermediary payment providers or digital currency exchanges your money passed through before reaching the scam. Any entity that your money passed through is potentially culpable by aiding the transfer of money to criminals.

What if I didn’t transfer money from my bank?

We can submit a legal challenge against any legitimate culpable entity who aided the transfer of money to a scam. This may include intermediary payment providers, banking Apps or cryptocurrency exchanges.

Do I have to attend court?

No. Our investigations are criminal, not civil, so there is no requirement to attend court. Our legal team handle the entire case on your behalf.

Do I have to pay any legal fees?

No. We cover all your legal fees.

Do you report my case to the police?

Although it is not absolutely necessary to report a scam to the police, we highly recommend doing so.
Having an official police crime reference number can strengthen your scam claim.

Our lawyers will register your case with the police via Action Fraud on your behalf.

Reporting the scam to the police may also assist their ongoing investigations into the crime to bring those responsible to justice.
